A new class action lawsuit accuses ExpressVPN of illegally charging consumers auto renewal fees for its virtual private network services without first obtaining consent.
Plaintiff Timothy Millar’s class action lawsuit claims ExpressVPN fails to provide the required clear and conspicuous disclosures or obtain affirmative consent prior to charging consumers the auto renewal fees.
Millar seeks to represent a California class of consumers who enrolled in an ExpressVPN plan through the company’s website and were charged for at least one automatically recurring payment during the statute of limitations.
Millar claims ExpressVPN’s auto renewal fees violate the state’s Automatic Renewal Law (ARL), which requires companies that sell automatically renewing subscriptions to provide clear and conspicuous disclosures about the auto renewal plan and obtain affirmative consent to enroll consumers.
ExpressVPN renewed plan without informed consent, class action claims
Millar claims he purchased one month of ExpressVPN’s virtual private network services in September 2022 and believed he was making a one-time purchase due to the company’s alleged misleading advertisements and deficient disclosures.
“Unbeknownst to him and without his consent, ExpressVPN enrolled him in an automatically renewing monthly plan,” the ExpressVPN class action lawsuit alleges.
Millar argues ExpressVPN’s alleged failure to comply with the ARL violates California consumer protection laws.
Millar demands a jury trial and requests declaratory and injunctive relief and an award of restitution and disgorgement on behalf of himself and the class.
VPN provider NordVPN is also facing a lawsuit over an alleged auto-renewal scam, while OnlyFans is accused of renewing subscriptions without consent. So far this year, both UFC Fight Pass and Streamlabs Pro agreed to class action settlements to resolve claims related to auto renewal practices.
